ARBITRATING COMMERCIAL LEASE DISPUTES

On 3 June 2020 there was temporary changes to the Property Law Act 2007 announced to help businesses impacted by COVID-19.

Disputes relating to Sale and Purchase Agreements

We frequently provide advice in respect of the interpretation of clauses in the Auckland District Law Society Agreement for Sale and Purchase of Real Estate, and advice in respect of available options in the event of disputes.

Personal Property Securities Act 1999

We can provide advice in respect of priority issues and
enforcement of security interests under the Personal Properties and
Securities Act 1999.

Lease disputes

We have a good knowledge of the standard lease agreements and often provide advice to both lessors and lessees regarding contractual rights and obligations and strategies in the event of disputes.

Consumer law

We have extensive experience with consumer claims, including claims under the Fair Trading Act 1986, Consumer Guarantees Act 1993, Contract and Commercial Law Act 2017, and the Credit Contracts and Consumer Finance Act 2003, amongst others.

Franchise disputes

We have provided advice to both franchisors and franchisees in respect of disputes arising under franchise agreements and the rights and obligations of the contracting parties.

Trust and estate issues

We can provide advice in respect of trustee obligations, relief for beneficiaries and issues in respect of the appointment and removal of trustees.

Leaky Homes

We have provided advice in respect of many "leaky home" disputes both in the Tribunal and Court, acting for homeowners, builders, and sub-contractors. We have acted in respect of claims involving smaller residential homes and also large scale unit title developments.

Construction Contracts Act 2002

We provide advice in respect of the provisions of the Construction Contracts Act 2002, including the preparation of Payment Claims and Payment Schedules.

Construction Disputes

Braun Bond & Lomas has experience managing numerous construction disputes, including (amongst others) disputes between principal and contractor, and contractor and sub-contractor as to quality, time, payment, variations and completion. Many of the disputes involve complex and technical building matters. We have managed numerous adjudications under the Construction Contracts Act 2002.

DISPUTES UNDER THE UNIT TITLES ACT 2010

We have a good working knowledge of the Unit Titles Act 2010 and frequently provide advice to unit title owners and Body Corporates relating to obligations under the Unit Titles Act, interpretation of various provisions and dispute resolution options under the Act.

EMPLOYMENT ISSUES

We can provide advice in relation to all aspects of the employer/employee relationship, and our lawyers have appeared in the Employment Relations Authority and in the Employment Court.

FARMING DISPUTES

We have acted in a number of disputes involving farming practices, farming funding, share-milking arrangements and animal health disputes.

RESOURCE MANAGEMENT

We have experience with the preparation of resource consent applications and opposition to resource consent applications, including attendance at Council hearings and appeals to the Environment Court. We have also dealt with prosecutions under the Resource Management Act.

DISPUTES UNDER THE PROPERTY LAW ACT 2007

We have experience in providing advice in respect of breaches, of and remedies under, the Property Law Act 2007 including encroaching trees, nuisance, trespass, division of property orders and prejudiced creditors orders.

We regularly advise clients in respect of solvency issues, including recovery of irregular, voidable and insolvent transactions, implications of insolvency on property, assets and creditor claims and the effects on employment and business activities.

DEFECTIVE CONSTRUCTION

In addition to our work involving “leaky homes” we have significant experience in other areas of defective building works, including buildings suffering from geotechnical issues, structural failure, and other issues of non-compliance with the Building Code or relevant standards.
